The problem has to do with clauses on the dispute settlement procedures between investors and states. Indeed it is possible that this treaty�s text is largely based on the Comprehensive Economic and Trade Agreement (CETA), which was signed last October between Europe and Canada. One of the provisions of this agreement called �fair and equitable treatment� protects �investors� legitimate expectations�.
The vagueness of this sentence is what worries NGOs and Civil Society environmentalists. Therefore, adding a hazardous substance to Annex XIV of REACH, which bans the substance, could be seen as contrary to investor interests and thus be challenged! The stakes are high as REACH is the most comprehensive and demanding regulation in the world when it comes to environmental and human health protection.
At the time of the implementation of the North American Free Trade Agreement (NAFTA), there were many disputes between the State and companies. American investors won 74% of their cases against neighbor states.
The European Commission voiced its concerns in July concerning the amendments of REACH, however, today�s news emphasizes the benefits that the TAFTA treaty could bring to the European economy, such as an increase of �119 billion to the GDP and the creation of hundreds of thousands of jobs. This raises the question: will environmental and public health regulations pay the price?
