GPSR: New Requirements for Product Safety and Online Sales

Regulation (EU) 2023/988 on General Product Safety (GPSR), also referred to as the General Product Safety Regulation, replaces Directive 2001/95/EC and introduces new requirements to ensure product safety. It came into effect on Friday, December 13th.

While compliance for your cosmetic products remains unchanged, new information must now be made publicly available for online sales.

Scope of Application

The GPSR applies to all economic operators involved in placing or making products available on the EU market, unless specific safety regulations already exist under EU law. This includes:

  • Manufacturers, authorized representatives, and importers of cosmetic products in Europe.
  • Distributors.
  • Fulfilment service providers and online marketplace providers.

Exclusions

Although primarily governed by Regulation (EC) No 1223/2009, cosmetic products are also subject to the GPSR regarding:

  • Online sales.
  • Dangerous product recalls.
  • Notifications via the Safety Gate portal.

Accessories and other items sometimes provided alongside cosmetic products (e.g., makeup brushes, cosmetic bags) fall fully within the scope of the GPSR.

Specific Requirements for Cosmetic Products

1. Online Sales:

  • Information Requirements: Compliance with Article 19 of the GPSR.

2. Dangerous Product Reporting:

  • Safety Gate Notification: Reporting dangerous products, accidents, or adverse effects (Article 20 of the GPSR).

3. Product Recall Notices:

  • Standard Recall Form: Use of the standardized form to notify consumers of recalls (Article 36 of the GPSR).

To optimize compliance and visibility for online cosmetic product sales, economic operators must include the following:

  • Compliance Details: Accurate information on the Responsible Person (name, company name, postal and electronic address).
