SEVESO/ ICPE: what's new in France?

The objective of these new texts is to reinforce the regulations in terms of prevention and preparation for the management of accidents.

The French Ministry of Ecology has published a summary of the � Post-Lubrizol regulatory changes�. The summary includes the requirements for each of the previously stated components. Since January 1, 2021, these requirements are applicable to new installations, with compliance deadlines extending to 2026.

On December 20, 2021, the French DGPR (Direction G�n�rale de la Pr�vention des Risques) shared a memo regarding modifications to facilities classified for environmental protection. What it says:

  • The operator of an installation classified for the protection of the environment (ICPE) must make declarations to the prefect when modifications are required.
  • These modifications may concern an installation, its mode of use or its vicinity leading to a significant change in the elements of the authorization.
  • The prefect must establish whether the modification is substantial, i.e. whether a new procedure is necessary.

 

Thus, you will have to keep the status of your stored materials up to date, in two different formats:

  • a format sent to the State services (in the case of an accidental event)
  • a format addressed to the population (for information purposes)

 

To note:

  • The Internal Operation Plan (IOP) must be updated as of January 1, 2023. For warehouses, the Fire Defense Plan (FDP) must be updated as of January 1, 2022.
  • A reinforcement of the controls of ICPE / Seveso sites is planned for this year, with an increase of 20 inspectors.

  • SEVESO high threshold establishments
  • SEVESO low threshold establishments

The type of establishment is determined by the total amount of hazardous materials on site. The security measures and procedures to be followed for an establishment vary according to their threshold.

 

An industrial or agricultural establishment is classified as an ICPE when it is likely to create risks or cause pollution/ nuisances for the safety and health of local residents. There are two types of possible risks: accidental risks (explosion, fire, leakage of toxic products, etc.) and chronic risks (prolonged exposure to small quantities of pollutants likely to have an impact on the health of the population).

In order to take into account the CLP regulation (Classification Labelling Packaging), the SEVESO 3 directive and the new nomenclature for classified installations (ICPE, Installation Class�e pour la Protection de l�Environnement)have come into force. Thus, your obligations are determined according to your regime (Declaration, Registration, Authorization) and according to the category of heading (substances, activities, activities falling under the directive on industrial emissions - IED, substances falling under the SEVESO directive).
