REACH is slowly limiting the use of hazardous substances and applying extensive bans, including substances that have been regularly used in manufacturing processes for years under controlled conditions. This affects worker�s safety, the way substances are used, the possible adjustment and substitution of processes and materials, but also companies within the supply chain that have to let their customers know about the potential presence of hazardous substances in their articles.
The survey results showed that about 20% of the companies did not believe they were concerned by REACH. 30% stated REACH was not essential to their industry and only 31 % of the smallest manufacturers acknowledged that REACH directly applied to them.
When it came to the chemical and rubber industries 100% deemed that REACH applied to them, however, for the other industries, the results dropped with 81% for transports, 58% for electrical and optical, and only 48% and 47% for machinery and metals respectively. The survey also demonstrated the companies� perception of REACH: expensive and complex.
If companies do not become aware of the upcoming REACH registration deadline in May 2013 or prepare for the substances withdrawal from the market, this could stop production in its entirety and non-compliant companies could be faced with significant fines or even prison.
The EEF is thus requesting the government to raise awareness about REACH and its consequences as well as accessible guidance explaining clearly in what cases the Commission allows the continued use of banned substances.
In fact, the European Trade Union Confederation (ETUC) and the IndustriALL trade union are working towards raising the awareness on companies� REACH requirements.
They are preparing two information leaflets: one with a simple checklist on what to do when companies import, manufacture or use chemicals and another one explaining the steps that need implementing to ensure the safe use of hazardous substances. A successful implementation of REACH could increase competition in the European chemical industry as well as improve worker, consumer and environmental protection.
