ECHA opens public consultation on its 13th draft recommendation for inclusion in REACH Annex XIV Authorisation list

The European Chemicals Agency (ECHA) has launched a public consultation on its 13th draft recommendation for inclusion in the REACH Authorisation List (Annex XIV), proposing four hazardous substances with significant industrial relevance. The Agency is inviting comments by 2 May 2026 on its draft recommendation to add the four substances to the list. Once added, these substance will be eligible to be included in the list of substances prohibited to be used ( authorisation list), unless auhtorised.

The four substances now proposed in ECHA's 13th draft recommendation cover a range of hazard profiles and industrial applications:

1. Bumetrizole (UV-326) — CAS No. 3896-11-5 Classified as a very persistent, very bioaccumulative (vPvB) substance under Article 57(e) of REACH, UV-326 was added to the SVHC Candidate List in January 2024. It functions as a UV stabiliser and is widely used as an additive in plastics, coatings, adhesives, and sealants, as well as in inks and finished articles.

2. UV-329 (2-(2H-benzotriazol-2-yl)-4-(1,1,3,3-tetramethylbutyl)phenol) — CAS No. 3147-75-9 Also identified as vPvB (Article 57(e)) and added to the Candidate List in January 2024, UV-329 serves primarily as a UV stabiliser in plastic and rubber articles, including packaging films and outdoor plastic goods.

3. Triphenyl phosphate (TPP) — CAS No. 115-86-6 TPP was added to the Candidate List in November 2024 on the basis of endocrine-disrupting properties for the environment (Article 57(f)). It is used as both a flame retardant and a plasticiser across polymers, coatings, adhesives, sealants, and a variety of finished articles.

4. 2-(dimethylamino)-2-[(4-methylphenyl)methyl]-1-[4-(morpholin-4-yl)phenyl]butan-1-one — CAS No. 119344-86-4 This photoinitiator is classified as toxic for reproduction (Repr. 1B, Article 57(c)) and was added to the Candidate List in January 2024. It is primarily used in UV-curable inks and coatings for industrial and professional applications.

Once substances move from the SVHC Candidate List to Annex XIV, companies cannot place them on the market or use them after designated sunset dates without specific authorisation from the European Commission.  

Following the close of the consultation on 2 May 2026, the Member State Committee (MSC) will prepare its opinion on ECHA's draft recommendation. ECHA will then submit its final recommendation to the European Commission, which will make the ultimate decision on inclusion in Annex XIV and the applicable conditions including sunset dates and latest application dates.
