It will enter into force within a year and will replace the existing directive, which has been into force since 1976. It is however, important to know that some provisions are already mandatory. Even if the regulation is a continuation of the directive, it brings a few additional constraints. Here is a summary of the points to keep in mind.
All cosmetic products containing nanomaterials other than UV filters, dyes and authorised preservatives will have to be electronically notified to the European Commission by the Responsible Person, at least 6 months before placing them on the market.
For such products already placed on the market before 11 January 2013 this notification has to be made between 11 January 2013 and 11 July 2013 (effective date of the regulation).
This notification must contain information defined in the regulation that allows the Commission to form an opinion on the hazards and risks of using the cosmetic product. If needed the Commission will be helped by the Scientific Committee on Consumer Safety (SCCS) that will have six months to issue a public opinion.
Concerning the labelling of the products, all ingredients present in the form of nanomaterials must be listed, followed by the word 'nano' in brackets.
In the cosmetic regulation, the Commission can take endocrine disrupting substances into account. The regulation may be revised as soon as new identification criteria are defined by the Commission until 11 January 2015.
When manufacturers cannot take their role, the regulation requires the appointment of a Responsible Person within the EU to place each cosmetic product on the European market. This person assures the product complies with obligations of the regulation. Cosmetic products cannot be placed on the market without a Responsible Person being appointed.
