Are the SCPR regulations comparable to REACH?

Implemented by the Department of Toxic Substances Control (DTSC), its objective is similar to REACH: consumer and environmental protection through the identification of dangerous substances and the development of a regulatory framework to limit risks.

 

To fall under the SCPR, a substance must meet at least one of these criteria:

  • Be part of one of the lists from Section 69502.2(a),
  • The Californian DTSC can add substances if they meet the criteria from section 69502.2(b) of the regulations, ie. if the substance exposed is recognised as dangerous and/or its endpoints show its toxicity.

According to the number of criteria the substance meets, it will be placed in the candidate list or initial list, which includes priority substances that will be assessed before 2016. Endocrine disruptors have not yet been included in this list, but the subject is under discussion.

This initiative is meant to be transparent with regular consultations with stakeholders as well as the public. These provisions are therefore quite close to REACH and it is tempting to consider SCPRs as an initiative to transpose European regulations to the American market. However, these two regulations are fundamentally independent.

Karl Palmer, chief of the DTSC�s Toxics in Products Branch, announced, in an interview, that they were �going to use the weight of evidence as best as [they could]� but that all the information available would have to be evaluated. He admitted it would be a challenge, and that stakeholder consultation will be implemented before any action in order to verify that no data is missing.

Industrials that have REACH-compliant substances/articles and who wish to sell their products in California do not have SCPR compliance as such, but the data accumulated during toxicology tests can give them a real advantage.
